Although we’re not yet a month into 2018, a number of potentially dangerous products have already been recalled by retailers and manufacturers. When a product is defective, potentially causing injury to users, the manufacturer will tend to recall the full batch to avoid both the risk and the resulting lawsuits. There are three categories of product liability claim which may apply to these items, including defects due to both design and manufacturing, and a lack of adequate instructions or safety warnings.
First Dangerous Product Recalls of 2018
One of the first potentially dangerous products to be recalled in 2018 was a range of UGG comforters, which were initially warmly welcomed by fans of the brand’s cozy sheepskin footwear. Following reports of mold growing inside the material, over 175,000 UGG Hudson comforters have been recalled by Bed Bath & Beyond.
The recall affects UGG Hudson comforters produced between August and October 2017 and includes all sizes (twin, queen, and king) and the four available colors – garnet, navy, grey, and oatmeal. Although no adverse effects on customers have been reported to date, the recall was instructed on the grounds of potential respiratory damage. Those with chronic health conditions or compromised immune systems are believed to be particularly at risk.
Product Liability Claims Relating to Defective Items
While the mold issue with the UGG comforters was discovered before any illness or injury occurred, users of defective products aren’t always as lucky. If you’ve been injured or fallen ill as a result of a defective product, you may be able to claim compensation with the help of a Riverside product liability attorney.
If the damages or injury is caused by, for example, a faulty appliance or car, an existing insurance policy may cover you. However, you should bear in mind that any insurance claim is likely to involve an investigation into your use of the product, in an effort to reduce liability and, therefore, the compensation you’re entitled to.
If you have found yourself in a situation where you feel you may have a valid product liability claim, your best course of action is to consult an attorney with extensive experience in the field, and a track record of success.
