You Walked Away From the Crash. Weeks Later the Headaches Started. That Can Be a Brain Injury.

On behalf of The Law Offices of Howard Kornberg Posted in Brain Injury

You got out of the car, told the officer you were fine, and went home. No broken bones. No blood. Just a sore neck and an odd, foggy feeling you blamed on the stress. Then three weeks pass. The headaches will not stop. You keep losing your keys, and your spouse says you have not been yourself. That is not you being dramatic. It can be a brain injury, and it may have started the moment your head snapped forward in the crash.

Doctors call the mild version a concussion. There is nothing mild about how it can wreck a life. Because it does not show up on a normal scan, it is the injury insurance companies fight the hardest.

Your brain can be hurt when your head never hits a thing

People think a brain injury needs a crack in the skull. It does not. In a crash, your car stops in a fraction of a second. Your brain keeps moving inside your skull and hits the bone. That one jolt can bruise tissue and stretch the fibers that carry your thoughts. You can have a serious brain injury with no cut on your head.

At the scene, your body floods with adrenaline. It hides pain and makes you feel steadier than you are. So a lot of hurt people wave off the paramedics and drive home. The adrenaline fades over the next day or two. What it was hiding does not.

The symptoms that show up late

A brain injury rarely announces itself. It leaks out over the days and weeks after the crash, and by then most people have stopped tying it to the accident. Watch for these in yourself, or in someone else who was in the car:

  • Headaches that will not quit, or keep coming back
  • Trouble remembering simple things, or finishing a thought
  • A short temper or sadness that is not like you
  • Dizziness or blurred vision
  • Sleeping far more, or far less, than normal
  • Light and noise that suddenly feel like too much

One symptom on its own might be nothing. Two or three of them together, a few weeks after a wreck, is a reason to act. See a doctor. Say it plainly: I was in a car accident, and something is wrong with my head.

Why the insurance company loves this injury

Here is the cold part. An adjuster can look at your MRI and see a clean scan. Then they tell you nothing is wrong. The truth is that many brain injuries never show up on standard imaging. The damage is real, but the machine misses it. The adjuster knows this, and uses it against you.

They also use the gap. Say you felt fine for three weeks and only then saw a doctor. Now they get to argue the headaches came from stress, or a bad pillow, not their driver. So the timeline matters more than people think. The longer you wait to get looked at, the more room they have to claim your injury is not tied to the crash.

The money at stake is not small. A brain injury can change how you work and how you parent. It can change who you are, in a way a broken arm never will. Some people cannot go back to the job they had. That is the loss the insurance company wants to talk you out of before you even understand it.

What to do if this sounds like you

A few steps protect both your health and your case, and none of them are hard. See a doctor now, not next month. Describe every symptom out loud, even the ones that feel silly. A medical record that ties your fog and headaches back to the crash is the strongest part of a brain injury claim. If your family doctor brushes it off, ask for a neurologist, because these injuries need someone who knows what to look for.

Keep a simple journal too. A few lines a day about the headaches, or the meeting you forgot. It sounds small. In a brain injury case, that plain daily record can carry more weight than a scan, because it shows a jury what the machine cannot. One more thing, and people get this one wrong the most: say nothing to the other driver’s insurance company on a recorded line before you talk to a lawyer. An adjuster is trained to get you to shrug the whole thing off.

The clock is already running

California gives you two years from the date of the crash to file a claim against the driver who hurt you. That feels like a long time, and it is the reason people wait. A brain injury case, though, takes months to build, and it leans on medical records that start the day you first report your symptoms. The longer you go without seeing a doctor, the weaker that link looks to a jury.
