Why the Truck Driver Log Book is Important in Accident Cases???

The truck driver logbook is one of the most important documents necessary for a truck accident case. Why? This book is a veritable log of each time the driver took a break from driving. It is also a record of the hours driven by the driver. Truck drivers are required to follow rules set forth by the Federal Motor Carrier Safety Administration (FMCSA) when it comes to the number of consecutive hours they are allowed to drive without taking a break. Hour Restrictions

The FMCSA sets forth restrictions for the number of hours truck drivers can drive without taking a break. The restrictions are that a driver can drive for 11 consecutive hours after having 10 consecutive hours of non-driving time. A driver can drive for no more than 14 consecutive hours if the driver took a break of 10 consecutive hours. There is also a 60/70 rule, which states a driver cannot drive if they just completed 60/70 hours of driving in a 7 or 8 day period unless they take 34 consecutive hours off from driving.

Logs Ensure Rest

One of the most important reasons that a truck driver logbook is used in an accident case is to look at the rest taken by the driver involved in the crash. Truck driver logbooks ensure that the drivers are getting the required rest and not continuing to drive past the state’s FMCSA regulations. If the log does not show the required time off from driving for the driver who was involved in an accident it could wind up being an open and shut case.

Logs Show Violations

This is an electronic device that monitors the driving habits of the driver as well as their operational times. It is very difficult to manipulate the logs of the EOBR because it is recorded electronically and not written down in a paper logbook. This device and the written logbook serve as strong pieces of evidence when commercial trucks are involved in accidents.
